   We are enclosing herewith Application for Registry, Bill of Sale and Registration Certificate on the captioned Aircraft.

   This piece of equipment formed a part of the Estate of George S. Frierson, deceased, whose succession has been opened and closed by a judgment of possession placing the heirs, consisting of two major children and a widow, Mrs. Minnie Wright Frierson, applicant on the enclosed, in possession of the effects of the deceased.

   For this reason, there has been no sale of the aircraft but simply an acceptance of the succession.

   There is also enclosed a certified copy of the judgment placing Mrs. Minnie Wright Frierson as naked owner of one-half and as usufructuary of the other one-half in possession of all the effects of George S. Frierson.

   We are enclosing herewith our check in the amount of $5.00 payable to the order of the Treasurer of the United States.

   We ask that you do whatever is necessary in order to effect the transfer of this aircraft in the name of Mr. Minnie Wright Frierson.

1949-11-22 Memorandum from Chief, Aircraft Records Branch to General Counsel's Office, requesting review of legality of transfer of ownership of Seabee to Mrs. Minnie Wright Frierson.  Reference was made to Judgment of Possession, Civil District Court For The Parish of Orleans, State of Louisiana, dated December 10, 1948, where Mrs. Wright Frierson and two sons were given one-half each of possession left by George S. Frierson.

1949-12-07 Note from General Counsel's Office, James M. Dikeman, Chief, General Opinions Division to Chief, Aircraft Records Branch:

...as it does not appear that the right of usufruct constitutes ownership in the State of Louisiana, the application for registration should include the names of the heirs of George S. Frierson, who, according to the judgment, are George S. Frierson, Jr., and James Wright Frierson.

1949-12-12 Letter from CAA, Chief, Aircraft Division to St. Clair Adams And Son:

Reference is made to your letter of November 1o, with which you forwarded an application for registration of Republic RC3 aircraft, serial number 920, registration number 6643K, in the name of Mrs. Minnie Wright Frierson, together with a certified copy of a judgment of possession.

The judgment of possession issued by the Civil District Court for the Parish of Orleans, State of Louisiana, Division "D", recognizes Mrs. Minnie Wright Frierson as owner of one half of the community property, including the aircraft, and an usufructuary of the other one half.  Title V of the Civil Aeronautics Act of 1938, as amended, provides for the registration of aircraft in the name of the owner, and as it does not appear that the right of usufruct constitutes ownership in the State of Louisiana, the application for registration should include the names of the heirs of George S. Frierson, who, according to the judgment, are George S. Frierson, Jr., and James Wright Frierson.

The application for registration in the name of Mrs. Minnie Wright Frierson is, therefore, returned.

   We are enclosing herewith a bill of sale signed by Minnie Wright Frierson, the widow of George S. Frierson and the Administratrix of her deceased husband's estate, transferring title in a Seabee airplane which is registered with you as N6643K to our client, Mr. Oscar Machado Zuluaga, of Caracas, Venezuela.

   Mr. Zuluaga has furnished us with Venezuelan Import License #574, and our State Department has furnished us with Export License #A-4090.  Venezuelan registry letters YV-T-ETQ have been placed on this airplane by the authority of the Venezuelan Government, and the United States registry, N6643K, has been removed from the ship.

   The airplane will leave on its ferry trip to Venezuela later this week, and it is our desire to cancel United States registry of this aircraft.

   We have on file a copy of the Judgment of Possession proceedings of the Civil District Court For The Parish of Orleans, State of Louisiana, appointing Mrs. Minnie Wright Frierson as Administratrix of the Estate of George S. Frierson, and under the powers granted she has signed the enclosed bill of sale.  Should you require these papers, please advise us.
